Supreme Court Rectifies Compensation Error: Enhances Amount Due to Misapplication of "Eggshell Skull Rule" in Medical Negligence Case, Sets Precedent for Just Compensation

In a significant ruling, the Supreme Court of India has overturned a decision regarding compensation in a medical negligence case, citing misapplication of the "Eggshell Skull Rule." The court has increased the compensation amount from Rs. 2 lakhs to Rs. 5 lakhs, highlighting persistent suffering post-surgery due to deficient service by the doctor.
The case revolves around a patient who suffered continuous pain near the surgical site post-surgery, eventually discovering a 2.5 cm needle near the site that required immediate removal. Despite lodging a consumer complaint seeking Rs. 19.8 lakhs in compensation, the patient was initially awarded Rs. 5 lakhs by the District Forum, but the amount was later reduced to Rs. 1 lakh by the State Consumer Dispute Redressal Commission and then increased to Rs. 2 lakhs by the National Consumer Dispute Redressal Commission (NCDRC).


The State Commission and NCDRC justified the reduced compensation amount by applying the Eggshell Skull Rule, attributing the patient's suffering to pre-existing vulnerability or medical conditions. However, the Supreme Court criticized this decision, noting a lack of discussion on the patient's pre-existing condition and questioning the application of the rule.
The Supreme Court set aside the decisions of the State Commission and NCDRC, restoring the original compensation amount of Rs. 5 lakhs awarded by the District Forum. The court emphasized that compensation must be just and questioned the rationale behind reducing the amount in the absence of a clear analysis of the patient's pre-existing condition.
This ruling underscores the importance of accurately applying legal principles in cases of medical negligence. By rectifying the misapplication of the Eggshell Skull Rule, the Supreme Court has ensured fair compensation for the patient's suffering, reaffirming the principle of justice in medical jurisprudence.
