Deceptive Promotion

Deceptive advertising involves using false, misleading, or unfounded assertions to market a product or service. The misleading act may be deliberate, or it can stem from carelessness or oversight.

Moral Structures

Deontology (Duty-Based Ethics): According to a deontological viewpoint, deceptive advertising is fundamentally unethical as it breaches the obligation of truthfulness. An advertiser holds a moral responsibility to present consumers with accurate and truthful information. Regardless of whether the deceit results in higher sales or satisfied customers, the breach of the obligation to be honest renders it unethical.

Utilitarianism: Viewed through a utilitarian lens, the penalty represents a beneficial advancement. The deceptive advertisements led to a detrimental result: consumers were misled, lost confidence, and suffered financial damage (even if minimal).

Virtue Ethics: This approach evaluates the character of the ethical actor. Rapido's actions reveal a deficiency in essential qualities such as honesty, integrity, and fairness. The company chose to focus on immediate profits through dishonesty rather than fostering a trustworthy relationship with its customers.

Regulatory Considerations

The Consumer Protection Act, 2019 grants the CCPA the authority to address deceptive advertising and unjust trading practices.

Section 20: Permits the authority to issue directives, such as halting unjust practices and reimbursing funds.

Section 21: Focuses on deceptive advertising, permitting penalties for endorsers, manufacturers, and service providers.

Path Forward

Tougher Penalties: For multiple infractions, implement increased fines and short-term suspensions.
