Constitution (130th Amendment) Bill, 2025:

Aims to allow for the dismissal of PM, CMs, or Ministers if imprisoned for serious crimes.

Applies to the Centre, States, Delhi, and is extended to the UTs of Puducherry and J&K via distinct Bills.

Reasons for Termination:

Major Offense: Charged with an act that carries a penalty of five or more years in prison.

Custody Provision: Requires being in arrest and confinement for 30 continuous days.

Steps for Elimination:

Ministers of the Union: Dismissed by the President upon the Prime Minister's recommendation (within 31 days).

Ministers of State: Dismissed by the Governor based on CM's recommendation (by the 31st day).

Delhi Ministers: Dismissed by the President based on the CM’s recommendation.

PM/CM must step down by the 31st day, or they will automatically lose their position.

Reappointment:

No lasting disqualification.

Ministers who have been removed may be re-appointed once they are released from custody.

Essential Consequences:

Seeks to maintain constitutional integrity, effective governance, and public confidence.

Nonetheless, it could be politically exploited, since mere detention—not a guilty verdict—initiates expulsion.

Fundamental Structure Breach:

Undermines parliamentary democracy by transferring critical authority from Parliament and Courts to executive discretion.
