Exploring the Multifaceted Relationship Between Artificial Intelligence and Ethical Dilemmas: Navigating the Intersection of Technology and Moral Principles

SC has recognized the right to protection from climate change impacts
In a landmark decision, the Supreme Court of India has recognized the right to protection from climate change impacts as an integral part of the fundamental rights enshrined in the Indian Constitution. This ruling, which emerged from a case concerning the conservation of endangered species, underscores the intersection of climate change and human rights, signaling a significant shift in legal interpretation and environmental advocacy.
Climate change affects various aspects of human rights, including the right to life, access to clean water and sanitation, health and well-being, migration and displacement, and indigenous peoples' rights. Rising sea levels, extreme weather events, water scarcity, and disruptions in ecosystems disproportionately impact vulnerable communities, exacerbating existing inequalities and threatening livelihoods.

Constitutional provisions such as Article 48A (mandating environmental protection), Article 51A(g) (promoting wildlife conservation), Article 21 (right to life), and Article 14 (right to equality before law) provide the legal framework for addressing climate change impacts. Previous judicial precedents, such as the MC Mehta vs Kamal Nath Case in 2000, have affirmed the right to a clean environment as an extension of the right to life.
The recent Supreme Court ruling strengthens the legal basis for environmental protection efforts in India and provides a framework for addressing climate change through judicial intervention. It aligns with international recognition of the human rights dimensions of climate change and underscores the role of the judiciary in safeguarding environmental rights.
Balancing climate change mitigation measures with human rights protection poses several challenges. Trade-offs between conservation efforts and human rights, access to essential resources, environmental migration, and prioritizing adaptation versus mitigation require careful consideration to avoid exacerbating social inequalities.
To address these challenges, a human rights-based approach to climate action is essential. This approach includes implementing progressive carbon pricing mechanisms, facilitating green technology transfer and capacity building, and conducting thorough human rights impact assessments before implementing climate policies.
The recognition of the right to protection from climate change impacts by the Supreme Court of India represents a significant step towards integrating environmental considerations into legal frameworks and policy decisions. By upholding human rights in the face of climate change challenges, India can pave the way for a more sustainable and equitable future for all its citizens.
