Apex Court emphasizes constitutional responsibility of Governors to act within a reasonable timeframe and uphold democratic principles

The Supreme Court of India has examined petitions concerning delays by Governors in granting assent to Bills passed by State Legislatures, highlighting the need for timely constitutional action. The Court observed that Governors cannot indefinitely withhold assent, as such delays undermine the functioning of parliamentary democracy and the will of the elected legislature.
The Court stressed that while the Constitution provides certain discretionary powers to Governors, these powers must be exercised within a reasonable timeframe. Prolonged inaction on Bills can disrupt governance, delay implementation of laws, and weaken democratic accountability. The ruling reinforces the principle that constitutional authorities must act in good faith and in accordance with democratic norms.

Referring to constitutional provisions, the Court highlighted the importance of Article 200, which governs the Governor’s power to grant, withhold, or reserve assent to Bills. It also emphasized Article 163, which mandates that the Governor acts on the aid and advice of the Council of Ministers, except in limited discretionary matters. The Court clarified that Governors are not elected representatives and must respect the authority of democratically elected governments.
This judgment is significant in preventing misuse or arbitrary exercise of constitutional authority. It strengthens federalism by ensuring that State governments can effectively implement legislative decisions without undue delay. It also promotes constitutional morality, accountability, and institutional balance between the executive and legislative branches.
The decision is expected to improve legislative efficiency, reduce governance delays, and reinforce democratic values enshrined in the Constitution of India.
