The Dual Mechanisms

Worldwide Discussion on AI Regulation:

Objective: A comprehensive UN platform for nations and participants.

Function: Platform for discussing crucial AI challenges that humanity encounters today.

United Nations Independent International Scientific Committee on AI:

Aim: Created as an inclusive multi-stakeholder platform within the United Nations for member states, civil society, academia, and the private sector to discuss significant AI challenges and governance matters.

Annual sessions are set for July 2026 in Geneva and July 2027 in New York.

Importance

Referred to as a “groundbreaking achievement” by the United Nations Secretary-General.

Seeks to harmonize the advantages and dangers of AI, promoting global cooperation.

Guarantees that AI advancements correspond with the overall benefit of humanity.

Intelligent Machines

Artificial intelligence (AI) is a comprehensive field of computer science focused on creating intelligent machines that can execute activities usually demanding human cognitive abilities.

Artificial intelligence enables machines to replicate, or even enhance, the functions of the human brain.

With the advancement of autonomous vehicles and the rise of generative AI applications such as ChatGPT, artificial intelligence is progressively integrating into daily life — and is a sector that every industry is putting resources into.

What is the necessity for regulations regarding AI?

Ethical Issues: AI technologies have the ability to make choices and execute actions that affect people and the community.

Setting rules aids in tackling ethical issues connected to AI usage, guaranteeing it aligns with human values and honors essential rights.

Confidentiality: AI frequently entails handling extensive data sets. Regulations can safeguard personal privacy by defining the methods for data collection, storage, and usage.

Security: This involves protecting against possible weaknesses and defending against the harmful applications of AI technology.

Transparency: Regulations may require transparency in AI systems, obligating developers to reveal the functioning of their algorithms.

Competition and Innovation: Creating a regulatory framework ensures fair competition among businesses, deterring market dominance abuse and promoting responsible innovation.

Public Safety: In instances where AI is applied in vital sectors like healthcare, transportation, or public infrastructure, regulations are crucial to guarantee the safety of individuals and the wider community.

Regulation of artificial intelligence in India

India lacks a specific AI legislation at this time. AI is regulated indirectly by current legal structures:

IT Act, 2000: Addresses cyber offenses, liability of intermediaries.

Digital Personal Data Protection Act, 2023: Guarantees privacy of data and user consent.

IPR regulations (Copyright & Patent Laws): Significant for works created by AI and advancements.

Global Partnership on Artificial Intelligence: India is a participant in the GPAI. The 2023 GPAI Summit took place in New Delhi, where GPAI specialists showcased their efforts on responsible AI, data governance, and the future of innovation, work, and commercialization.

The National Strategy for Artificial Intelligence #AIForAll initiative, by NITI Aayog: It included guidelines for AI research and development centered on healthcare, agriculture, education, intelligent cities and infrastructure, and smart mobility and transformation.

Principles for Responsible AI: In February 2021, the NITI Aayog published Principles for Responsible AI.

What is the need for rules concerning AI?

Ethical Concerns: AI technologies can make decisions and carry out actions that impact individuals and society.

Establishing guidelines helps address ethical concerns related to AI implementation, ensuring it is consistent with human values and respects fundamental rights.

Confidentiality: AI often involves managing large data collections. Rules can protect individual privacy by outlining the processes for gathering, storing, and utilizing data.

Security: This entails safeguarding against potential vulnerabilities and shielding against the detrimental uses of AI technology.

Transparency: Regulations might mandate that AI systems disclose their inner workings, requiring developers to explain how their algorithms operate.

Competition and Innovation: Establishing a regulatory framework fosters equitable competition among firms, preventing the misuse of market power and encouraging responsible innovation.

Public Safety: When AI is utilized in essential areas such as healthcare, transportation, or public infrastructure, regulations are important to ensure the safety of individuals and the broader community.

Governance of artificial intelligence in India

Currently, India does not have a dedicated AI law. AI is governed indirectly through existing legal frameworks:

IT Act, 2000: Covers cyber crimes, responsibility of intermediaries.

Digital Personal Data Protection Act, 2023: Ensures data privacy and user consent.

IPR laws (Copyright & Patent Regulations): Important for AI-generated creations and technological progress.
