Concerning the legislative procedure in India

All legislative proposals are presented to Parliament as Bills that may be introduced in either the Lok Sabha (Lower House) or Rajya Sabha (Upper House).

A Bill is a proposed law, and it cannot become legislation until it has the consent of both Houses of Parliament and the approval of the President of India (Article 111).

  • India's legal structure permits two categories of Bills:
  • Public Member Bills (proposed by Ministers), also known as Government Bills; and
  • Bills proposed by Members of Parliament who are not part of the government.

Although Public Member Bills constitute the majority of laws enacted, Private Member Bills act as a crucial mechanism for MPs to introduce independent legislation.

Private Members' Bills

These enable non-Minister MPs to present legislation that represents personal beliefs, needs of their constituents, or new social issues.

The final two and a half hours of the Sitting each Friday are typically designated for handling Private Members’ matters.

Every other Friday is allocated for Private Members’ Bill, while the remaining Friday is designated for Private Members’ Resolutions.

Decrease in Discussions on Private Member Bills: Trends

Since gaining Independence, just 14 Private Member Bills have been approved and received the president's approval. Since 1970, no Private Member Bill has passed through both Houses of Parliament.

17th Lok Sabha (2019-24): 729 Private Member Bills were presented in the Lok Sabha, while 705 were done so in the Rajya Sabha. Nonetheless, only two in the Lok Sabha and 14 in the Rajya Sabha were ever addressed.

18th Lok Sabha (2024-Present): To date, only 20 MPs have tabled Private Member Bills. In the Budget Session of 2024, 64 Private Member Bills were presented in the Lok Sabha, yet none were debated.

Importance of Private Member Bills (PMBs)

Promoting Legislative Creativity: Private Member Bills offer MPs a chance to propose laws that extend beyond party directives.

One example is the Right to Disconnect Bill, aimed at providing employees with a legal entitlement to disengage from work-related communications outside of official hours.

Democratic Involvement and Responsibility: Enables regular MPs to impact policy, thereby reinforcing parliamentary democracy.

Promotes the expression of various perspectives and local issues in the House.

Pressure Dynamics on the Government: PMBs frequently initiate discussions and generate public pressure, urging the government to address the concerns highlighted.

Policy Testing Grounds: PMBs serve as a testing area for public and political responses to policy proposals.

Path Ahead: Suggestions for Renewal

Focusing on Private Member Bill Debates: Set aside specific time slots for discussions on Private Member Bills to promote significant legislative participation.

Minimizing Interruptions: Avoid premature recesses that obstruct discussions on Private Member Bills.

Promoting Collaboration Across Parties: Cultivate bipartisan backing for Private Member Bills that tackle urgent social and economic challenges.

Committee for PMBs: Form a specialized group of experts and MPs to evaluate and select high-impact PMBs for prioritized discussion and voting.

Extend Parliament's Working Hours: Lengthen sitting hours or designate evening sessions to guarantee that both government and private members’ affairs get sufficient time.

Final thoughts

Reinstating the Private Member’s Bill process is essential for enhancing India’s democracy and promoting legislative variety.

By emphasizing dialogue, minimizing interruptions, and encouraging teamwork, India can revive the importance of Private Member Bills, enabling MPs to play a significant role in the country's governance.
