Unraveling the Passport Predicament for Goans
In a recent turn of events, the Ministry of External Affairs (MEA) memorandum has set forth a chain of passport revocations affecting over a hundred individuals from Goa. These individuals, unbeknownst to many, stand accused of concealing vital information when attempting to surrender their passports after acquiring Portuguese citizenship. This unfolding saga sheds light on the complexities surrounding nationality, citizenship, and the implications of such legal measures on individuals and communities.
Goa, nestled along India's western coast, bore the weight of Portuguese colonial rule for nearly four and a half centuries, spanning from 1510 to 1961. The region, conquered by Afonso de Albuquerque, flourished as a crucial trade hub in the Eastern spice trade. Notably, Goa served as the capital of the entire Portuguese Empire east of the Cape of Good Hope, symbolizing the enduring legacy of colonial influence.
Portuguese law extends a unique provision to individuals born in Goa before December 19, 1961, along with their descendants, offering them the option to register as Portuguese citizens. This opportunity, coupled with the allure of visa-free travel and access to employment and educational opportunities in Europe, has spurred many Goans to pursue Portuguese citizenship.
The memorandum issued by the MEA in November 2022 specifically addresses the surrender of Indian passports by erstwhile Indian citizens who have acquired foreign nationality. Under section 10 (3) (b) of the Passport Act of 1967, passports obtained by concealing the fact of holding another country's citizenship can be cancelled, irrespective of whether they were used for travel.
Previously, passport authorities imposed penalties for surrendering Indian passports, but a 2020 Kerala High Court judgment invalidated this practice, restricting authorities to prosecute only for violations of the Passports Act. Subsequently, the MEA's directive instructed passport authorities to issue 'revocation certificates' instead of surrender certificates in cases where Indian passports were obtained by concealing information.
The revocation of Indian passports has left affected individuals in a precarious situation, particularly concerning their eligibility for Overseas Citizenship of India (OCI). OCI status, which permits foreign citizens of Indian origin to reside and work indefinitely in India, has been a coveted option for many Goans. However, the revocation of passports has hindered their ability to apply for OCI cards, as a 'surrender certificate' was a prerequisite for OCI application.
The OCI scheme, introduced in 2005, caters to the Indian diaspora's demand for dual citizenship. It grants multiple entry, multi-purpose lifelong visas to visit India, along with exemptions from registration requirements. However, OCI cardholders are subjected to certain limitations, such as restrictions on land ownership and political participation.
The OCI card scheme has been instrumental in fostering stronger ties between India and its diaspora, with millions of OCI cards issued worldwide. However, the recent passport revocations in Goa underscore the challenges faced by individuals navigating complex citizenship dynamics. As legal battles unfold and individuals seek recourse, it is imperative for authorities to balance legal compliance with humanitarian considerations.
