BCI mandates social media ethics guidelines for advocates, law students, and legal institutions

The Bar Council of India (BCI) has directed all State Bar Councils and law colleges to immediately implement its newly issued social media and digital ethics guidelines, making them applicable to advocates, law students, interns, and research scholars across the country.

According to a BCI circular, the guidelines are intended to promote responsible online conduct, preserve the dignity of courts, and safeguard professional confidentiality.

The Council instructed legal institutions not to treat the directions as a routine advisory and emphasized that they must actively educate students and advocates about the new norms instead of merely uploading the circular on websites or forwarding it through messaging platforms.

The guidelines cover students enrolled in LLB, LLM, PhD, diploma, certificate, and other law-related programs, as well as interns and research scholars.

The BCI said the decision follows a growing trend of social media content centered on courts, legal internships, and judicial proceedings.

"The Bar Council of India has taken serious note of a growing and disturbing tendency among some Advocates, law students, interns and social media users to create, upload, circulate, forward or promote reels, videos, short clips, edited visuals, thumbnails, memes, dramatic presentations, promotional posts and other social media content depicting Court premises, Court corridors, court-related activities, chambers, internships, professional engagements, judicial hearings and, in some cases, selected portions of live-streamed Court proceedings," the official notice states.

The Council also raised concerns over the spread of legal misinformation on digital platforms.

"The digital space is increasingly being used for legal misinformation by persons who are not enrolled Advocates and, in some instances, by law students, interns or self-styled legal influencers who present oversimplified, sensational or inaccurate content as legal advice."

Highlighting concerns over internship-related content, the BCI said some students have been sharing videos and photographs of chamber work, client meetings, court visits, and case files on social media, potentially compromising professional ethics and confidentiality.

"If even investigating agencies must respect professional privilege and confidentiality, it follows with greater force that interns, juniors, associates, clerks, staff and social media handlers cannot casually disclose, record, dramatise or publish chamber discussions, client details, case strategy, pleadings, drafts, research or internal professional work."

The circular directed law colleges to reinforce that internships are designed to develop legal knowledge, courtroom skills, and ethical conduct rather than serve as content for online promotion.

"Internships are meant for learning discipline, humility, research, drafting, observation, court craft, professional ethics and responsibility" and "not meant for social media display, self-promotion or dramatisation of Court life."

Under the guidelines, recording court proceedings or client meetings, disclosing litigation strategies or case-related information, and posting content such as "day in Court," "day in chamber," "internship reveal," "case file," "courtroom drama," or "lawyer life" are prohibited if they compromise confidentiality or undermine the seriousness of judicial proceedings.

The BCI warned that violations could result in disciplinary measures depending on the severity of the misconduct.

These may include denial of internship opportunities, reporting students to their law colleges, internship coordinators, Bar Associations, or law firms, as well as counseling, warnings, and other actions permitted under applicable rules.

The Council clarified that the guidelines are intended to promote awareness and prevent professional misconduct rather than suppress lawful criticism or encourage action based on unverified allegations.

It has directed all State Bar Councils and legal education institutions to ensure the immediate implementation of the new framework.
