Digital censorship has been a topic of discussion again because of the recent controversy surrounding the show "India's Got Latent."

Since social media platforms, streaming services, and independent journalism have grown in popularity, discussion about the regulation of digital content in India.

The control or suppression of online content by governments, organizations, or other entities is known as digital content censorship. This comprises:

  • blocking apps and websites
  • Elimination of social media content and control over over-the-top (OTT) streaming services
  • Digital journalism and news restrictions

India's Laws Controlling Digital Censorship

  • Article 19(2) permits reasonable limitations on the right to free speech in relation to public order, morality, and decency.
  • The government has the authority to block internet content for security or public order reasons under Section 69A of the Information Technology (IT) Act of 2000.
  • The 2021 Intermediary Guidelines and Digital Media Ethics Code controls digital news media, OTT platforms, and social media.
  • OTT Platform Self-Regulation Digital Publishers Content Grievances Council (DPCGC) and other self-regulatory frameworks are followed by platforms such as Netflix and Amazon Prime.
  • Aiming to subject streaming platforms to the same censorship laws as movies, the Cinematograph Act of 1952 (Amendments for OTT Platforms) is being discussed.
  • The 2023 Press & Registration of Periodicals Bill aims to control digital news sources and guarantee editorial responsibility.

Views of the Supreme Court on Digital Censorship

The case of Apoorva Arora v. Govt. of NCT of Delhi (2024) highlighted the necessity of objective standards to define obscenity, concentrating on whether the content provokes lustful or sexual thoughts instead of the perceived decency of language. Subjective interpretation is still difficult, though.

Free speech, independent journalism, and creativity are all at risk from a digital censor board. While limiting harmful content is important, any regulation must be fair, open, and balanced in order to preserve democracy and creativity. The internet should continue to be a forum for free speech and discussion, making sure that censorship doesn't turn into a means of repressing dissent or exercising political control.
